The referenced warning letter stated the following:
“FDA received your Premarket Tobacco Product Application (PMTA) assigned STN PM0001175 on September 7, 2020. However, FDA issued a negative action for PMTA STN PM0001175 in the form of a Refuse to File determination on August 9, 2021, which covers 33 products.”
We have no receipt of this determination.
We weren’t aware that we didn’t meet the threshold determination of whether the application contains sufficient information to permit a substantive review, nor that the FDA refused to review our PMTA due to the criteria in § 1114.27(b)(1).
As a small business, we were in verbal correspondence with FDA officials. We were pending a request for samples related to our application for further evaluation of our overall application.
Furthermore, in response to the section titled “New Tobacco Products Without Required Marketing Authorization are Adulterated and Misbranded” on the website https://calisteam.com, we have confirmed the inability of United States customers to purchase products that were not properly listed within our PMTA application.
Additionally, we are currently in the process of preparing our annual updates to the tobacco registration and product listing (TRLM) by December 31st, 2022.
Lastly, due to the pandemic and ongoing economic conditions we are nearing bankruptcy and by threatening our company you will be responsible for for us closing our doors permanently in the 1st quarter of 2023. We have business loans that need to be paid off with not only the SBA (Small Business Association) but also a private loan company amounting over $175,000. We are barely able to make our payments as of now and if you cut our website off then you will collapse our foundation and you will be responsible for adding additional debt to the United States whopping 31 Trillion dollar debt crisis and displacing more Americans. What are you going to do? Are you coming for our petty $4,000-$5000 monthly revenue that allows us to barely scrape by? We are not big fish, if that's what you are looking for. We have had a 90% decrease in revenue within the last 2 years but still continue to serve our handful of longtime customers because they enjoy our products, it makes us happy to continue to serve them.

We took all the necessary steps and worked our butts off day in and day out to stay in compliance and suffered quite a lot due to your absurd, grating, totalitarian dictatorial requests. There was absolutely nothing democratic with your approach in how you designed the PMTA.
We have already made the hard decisions to let go of all of our temporary workers due to the lack of sales, limits on shipping options and absurd increased tax rates that are designed to cripple small businesses. You have designed the PMTA to wipe out everyone except for Big Tobacco and other multi-million dollar companies, because those were the very companies that lined your pockets to do so. We all know that is how the FDA makes their decisions. You are all bought. The government is doing a GREAT job at decimating and violently displacing us hard working middle class folks. Meanwhile, you approve of poisonous fast food chains such as McDonalds and poisonous energy drink companies that have slowly killed millions of people….but not before generating billions of dollars of revenue annually for Big Pharma. ]]>The state of California is taking a strong stance on regulating vaping products. In an effort to reduce the number of people vaping and to protect public health, the state is implementing a number of regulations that will affect both manufacturers and consumers.

]]>The legislation requires online sellers of e-cigarettes to ensure that the delivery carrier verifies the age of the recipient upon delivery. It also requires online sellers to collect and remit the appropriate state and local taxes.
As part of the “Consolidated Appropriations Act, 2021,” in the most recent COVID-19 relief bill signed into law on December 27, 2020, Congress amended the Prevent All Cigarette Trafficking (“PACT”) Act to apply to e-cigarettes and all vaping products. Originally passed in 2009, the PACT Act amended the existing Jenkins Act of 1949, which required interstate shippers to report cigarette sales to state tobacco tax administrators in order to combat illicit sales and tax avoidance. When it became law 60 years later – the same year the Tobacco Control Act gave FDA authority over tobacco products – the PACT Act, among other things, prohibited the use of the U.S. Postal Service (“USPS”) to deliver cigarettes and smokeless tobacco products directly to consumers.
Critically for the vapor industry, the most commonly used carriers, Federal Express and United Parcel Service (UPS), have recently announced that they would cease all deliveries of vapor products. According to Vaping360, as of March 1, 2021, FedEx will begin prohibiting “electronic cigarettes, vaping liquids, and other vaping products in the FedEx global network.” A UPS spokesperson also told Vaping360 that, effective April 5, 2021, “UPS will not transport vaping products to, from, or within the United States due to the increased complexity to ship those products.”
Without effective delivery options, PACT Act compliance becomes moot. Many vapor businesses are exploring arrangements with private logistics and transportation companies, as well as expensive software solutions to help comply with the PACT Act requirements, but the outlook for many small vapor companies and online retailers looks bleak.
]]>On December 27th, 2020 the vape mail ban (S.1253) was signed into law. This new law prohibits any vapor-related products from being shipped with USPS. Following the passage of the new law, the major private delivery companies announced that they too would stop delivering vaping products, not just to homes but also to businesses. FedEx stopped shipping vape products on March 1, and UPS will stop shipping vape products on April 5.
The overall effect of this ban will make it nearly impossible to ship vapor products directly to customers. Also the costs associated with FDA compliance and absurd taxation is driving us to the ground. We are almost certain we will no longer be able to ship directly to customers unless amendments are made to the current law. We will most likely have to shut down temporarily, until a solution is found.
Our entire community is sickened by this absurdity and will continue to fight against these evil ASSHOLES and political fluffers, who continue to line the pockets of dirt-bag politicians who have devised a plan to decimate a majority of the vape industry, forcing all small businesses to throw in the towel and allowing big tobacco companies to monopolize the market once again.
It is extremely sad to see many of our friends and colleagues who own mom & pop brick and mortar and online businesses, close their doors for good. We will continue to closely monitor this incredibly unfortunate situation and will keep all of you updated. We will do everything in our power to fight and we will use all of our resources until the well runs dry. We will not give up this fight!

]]>Crosthwaite, CEO of Juul, says he is “very excited” to make its case. He plans to submit scientific studies showing Juul products can be a beneficial alternative for smokers, and will highlight the company’s plans to limit vaping by minors.
In his nine months at the helm, Crosthwaite has joined President Donald Trump at the White House and testified before a House committee. He declined to elaborate on any additional meetings he’s had.
The shift hasn’t been painless. Juul slashed about 40% of its workforce through two rounds of cuts, and remaining employees have had to adapt quickly as the company grappled with the public furor around vaping.
“If we have an employee who doesn’t agree that earning the license to operate is important or building trust with stakeholders is important, then this is probably the place they shouldn’t be,” Crosthwaite said. “We firmly believe that that is the right approach and that is the path we’re pursuing.”
Juul’s market share declined about 10% over the past year, even as it still represents 60% of sales in convenience stores and similar outlets, according to market research firm IRI. Crosthwaite says he’s OK with a shrunken business as long as it is pursuing the right strategies.
First-quarter sales reached $394.2 million, according to a financial disclosure viewed by Bloomberg News. If the trend holds for the year, Juul could surpass the $1.3 billion in sales recorded in 2018, while still falling short of the $2 billion seen last year.

]]>As Italy went into lockdown to stop the spread of Covid-19, among the businesses to be closed were vape shops. But then the Italian government did a U-turn and allowed them to stay open, largely thanks to lobbying from one man, respiratory specialist Riccardo Polosa. He pointed out that if Italy’s million or so vapers couldn’t access e-cigarettes, they were going to turn to smoking tobacco instead to meet their nicotine needs, damaging their health even more in the process.
Polosa’s research had shown that among people with smoking-related diseases - in particular COPD (chronic obstructive pulmonary disease) - there are harm reduction benefits in switching to vaping.
In New Zealand, where around 12.5 percent of us continue to smoke tobacco daily, we are putting our faith in e-cigarettes as part of the arsenal of quitting tools available to help us reach our target of being smoke free by 2025.
“Cessation rates need to increase a lot if we’ve got any chance of meeting the 2025 goal,” says Janet Hoek, a public health specialist from the University of Otago and co-director of ASPIRE 2025.
“For some people vaping has been a way to stop smoking but the challenge is to give them that option without creating another problem along the way.”
Since 2018, when the sale of nicotine e-cigarettes was legalised in New Zealand, it has become a free-for-all, with thousands of outlets including dairies, petrol stations and even post shops now supplying them. Stylish devices and a range of flavours have appealed to a new younger generation who aren’t necessarily smokers and Big Tobacco, now a major player in the industry, hasn’t been shy of marketing products to them.
So far it seems to be working. The Youth 19 Survey, conducted in New Zealand schools last year, found that 48 percent of those between the ages of 13 and 18 who regularly vaped had never smoked cigarettes.
And there are more statistics to tell a worrying story. Over the past 20 years there had been a sharp drop in cigarette use among adolescents. But recently, as the numbers of young vapers has increased, that decline has shown signs of levelling out - even seeming to be starting to rise again.
“If vaping was displacing smoking, which is the argument that some people have presented, then we would expect that downward trajectory in smoking to continue. In fact we’d expect it to accelerate, and that’s not what the data is showing us,” says Hoek.
Even for those who want to use them to quit smoking, vapes aren’t a magic bullet. The largest New Zealand study so far found that between only 7 percent and 17 percent of participants using a combination of patches and nicotine e-cigarettes were smoke free after six months. International research backs up those modest rates of success.
“For some people it’s not a smooth transition,” explains Hoek. “They need to persist, they need to show resilience and that can come as an unwelcome surprise for people who think vaping is going to present them with a solution that is a lot easier than the other stop-smoking treatments they’ve tried. So we need to make sure they get good advice. The work we’ve done with generic retailers, particularly dairy owners, shows they’re not getting good advice there. We also know those corner stores are outlets that young people are likely to go to.”
The type of advice that quitters might need includes guidance on the best device to choose, the ideal nicotine level of their e-liquid, and how quickly or slowly they should attempt the transition from cigarettes. ASPIRE 2025 believes vape outlets should be seen as providing a health service, rather than a recreational tool, and so proper training and a licensing system is crucial.
While the evidence so far suggests that vaping poses a lesser risk than smoking cigarettes or using heated tobacco products, it it isn’t harm-free. There is convincing science to show vaping can damage the cardiovascular system as well as impair the immune response within our airways.
Chris Bullen of the University of Auckland has been researching e-cigarettes for a decade - it was his study that showed they do have a modest benefit for quitters - and he believes that ideally the devices should be a step towards reaching the point of inhaling nothing but clean air.
“If you’re a vaper, and you used to be a smoker, stopping would be fantastic,” he advises. “If not, then try to vape as little as possible to keep from smoking.”
Bullen advocates that vape stores should be graded from A to D - much like food outlets - to show how well the staff have been trained in giving quit smoking advice and that the products sold have passed quality standards. “If they lose that rating, then they go out of business,” he says.
Currently Parliament is considering a proposal to ban sales of vape products to under 18s, limit the flavours available in general stores such as dairies and ban advertising. Hoek for one believes we are missing an opportunity to not only control the vape industry and prevent it targeting young users, but to improve our chances of being smoke free by 2025.
